These Terms of Service (“Terms”) govern your access to and use of CapSafe’s website and services (the “Services”). By accessing or using the Services, you agree to these Terms.

Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Services.

Accounts and responsibilities

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You agree not to misuse the Services or attempt to access them in an unauthorized manner.

Property submissions and content

If you submit information or materials (including documents), you represent that you have the rights to do so and that the submissions are accurate to the best of your knowledge. If you submit a property listing (including photos, videos, floor plans, or other media), the “Sellers & Brokers (Listings)” terms below also apply.

Sellers & Brokers (Listings)

This section applies if you submit, upload, or post data, text, photographs, floor plans, video, or other materials (“Content”) regarding a property for sale or lease (a “Listing”) to CapSafe.

1. Submission of Listings

By submitting a Listing, you acknowledge and agree that you are effectively publishing the Listing and associated Content to a marketplace that may be viewable by the public (including prospective buyers, investors, and other third parties).

2. Grant of License to CapSafe

You retain ownership of the Content you submit. However, to operate our marketplace and market your Listings, you grant CapSafe (and its successors, assigns, and affiliates) a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and sublicensable license to reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such Content (in whole or in part) worldwide.

This license includes use of your Content in any format or medium now known or later developed for the purpose of promoting your Listing and the Services, including:

  • Social media: Featuring Listing images and details on platforms such as Instagram, LinkedIn, TikTok, and X (Twitter).
  • Email marketing: Including your Listing in newsletters and alerts sent to prospective buyers or investors.
  • Advertising: Using images and details from your Listing in paid advertisements (for example, Google Ads or Meta Ads).
  • Syndication: Distributing your Listing to third-party partners or aggregator sites where applicable.

3. Right to Modify

You agree CapSafe may modify your Content for technical or marketing purposes, such as:

  • Resizing or cropping images for responsiveness or ad formats
  • Editing Listing descriptions for grammar, clarity, or length restrictions
  • Adding watermarks or CapSafe branding to the presentation of a Listing to help deter unauthorized copying or scraping

4. Your Representations and Warranties

You are solely responsible for the Content you submit. You represent and warrant that:

  • Authority: You are the owner of the property or a duly authorized agent of the owner with full right and authority to list the property and grant the licenses set forth above.
  • Copyright clearance: You own the copyright to the photographs and other media you upload, or you have obtained express permission from the creator to use them for commercial marketing and to grant the license above.
  • Accuracy and compliance: The information provided in the Listing is truthful and accurate to the best of your knowledge and complies with applicable real estate laws, fair housing requirements, and truth-in-advertising laws.

You agree to defend, indemnify, and hold harmless CapSafe from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to your Content, including any allegation that your Content infringes or misappropriates a third party’s intellectual property or other rights.

5. Removal of Listings

CapSafe reserves the right, but not the obligation, to remove or refuse to post any Listing for any reason, including Listings that we believe violate these Terms, violate applicable laws, or are low quality (for example, poor resolution images). Removal of a Listing does not require CapSafe to recall or delete prior distributions of marketing materials, communications, or cached/archived copies created in the ordinary course of operating the Services.

Prohibited conduct

  • Violating laws or regulations
  • Infringing intellectual property or privacy rights
  • Uploading malware or attempting to disrupt the Services
  • Scraping, reverse engineering, or abusing rate limits

No investment, legal, or tax advice

The Services are provided for informational purposes only and do not constitute investment, legal, accounting, or tax advice. You are responsible for your own decisions and for consulting qualified professionals as needed.

Third-party services

The Services may link to or integrate with third-party services. We are not responsible for third-party content, policies, or practices.

Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CAPSAFE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.

Changes

We may update these Terms from time to time. The updated Terms will be posted on this page with a revised “Last updated” date.

Security & Data Protection (Summary)

The following describes CapSafe’s general security and data protection practices. This section is provided for transparency and does not create any warranty, guarantee, or commitment that the Services will be uninterrupted, error-free, or free from unauthorized access.

Information Security Governance

CapSafe is committed to protecting the confidentiality, integrity, and availability of customer data. Our security program is designed to identify, mitigate, and monitor risks.

Risk management framework

We employ a risk-based approach to information security:

  • Risk identification: We periodically review our infrastructure, codebases, and third-party vendors to identify potential security threats.
  • Risk mitigation: Identified risks are prioritized based on severity and impact. Mitigation strategies may include technical controls (e.g., encryption), administrative controls (e.g., policies), and physical controls (e.g., restricted access).
  • Monitoring: We utilize automated monitoring tools to detect anomalies in our systems and infrastructure.

Roles and responsibilities

  • Security oversight: CapSafe designates individual(s) responsible for overseeing our information security program.
  • Reporting: Security concerns (including suspected vulnerabilities) can be reported to support@cap-safe.com.

Policy review

These practices are reviewed at least annually, and additionally upon significant changes to our technical environment, to remain aligned with industry standards and the evolving threat landscape.

Access Control & Authentication

CapSafe adheres to the Principle of Least Privilege (PoLP). Access to production environments and sensitive data is restricted to authorized personnel whose job functions require such access.

Production environment access

  • Role-based access control (RBAC): Permissions are assigned based on roles.
  • Periodic review: Access rights are audited periodically.
  • Revocation: Access is revoked promptly upon termination of employment or contract (or when access is no longer required).

Authentication requirements

  • Multi-factor authentication (MFA): MFA is enforced for administrative access to critical infrastructure, cloud providers, and source code repositories where supported.
  • Customer security options: We may provide and/or support MFA options for end-users where available.

Physical security

As a cloud-first organization, CapSafe relies on leading cloud service providers to maintain physical data center security controls. CapSafe personnel perform work on secured, password-protected devices, and we encourage the use of full-disk encryption and other industry-standard endpoint protections.

Data Protection & Encryption

Data in transit

Data transmitted between clients (web/mobile browsers) and our servers is encrypted using industry-standard protocols.

  • Protocol: We enforce the use of Transport Layer Security (TLS) 1.2 or higher where supported.
  • Certificates: We utilize certificate management practices designed to maintain secure connections.

Data at rest

Where applicable, sensitive data is encrypted at rest.

  • Encryption standards: We use encryption mechanisms consistent with modern industry standards (e.g., AES-256 or equivalent).
  • Key management: Encryption keys are managed with access controls and stored separately from the data they protect where feasible.

Vulnerability Management

CapSafe maintains a vulnerability management program to detect and remediate security issues.

Scanning & detection

  • Code scanning: We may use automated scanning in CI/CD pipelines to identify vulnerabilities in dependencies and code prior to deployment.
  • Infrastructure scanning: We may leverage automated scanning tools and controls provided by our infrastructure partners to identify patch levels and misconfigurations.

Patch management

  • Critical patches: Security updates classified as critical are applied on an expedited timeline where feasible.
  • Routine maintenance: Non-critical updates may be applied during scheduled maintenance windows.

Responsible disclosure

If you believe you have found a security vulnerability in CapSafe, please report it to support@cap-safe.com. Please do not publicly disclose the issue until we have had a reasonable opportunity to investigate and address it.

Data Retention & Deletion

CapSafe retains user data only as long as necessary for the purposes for which it was collected, including to comply with legal, accounting, or reporting obligations.

  • Active accounts: Data may be retained while an account is active.
  • Operational and regulatory needs: Certain records may be retained as required by applicable laws or regulations.

Upon request or account termination, data may be deleted or anonymized in accordance with our processes and applicable requirements.

  • Deletion: We maintain processes intended to remove or anonymize personal data from production systems where applicable.
  • Backups: Data stored in backups may persist until backup retention periods expire and are overwritten in accordance with backup lifecycle practices.
